These Terms of Use (“Terms”) form a binding agreement between you (“you”) and Horology Books, a division of NSM (“Horology Books,” “we,” “us,” or “our”) regarding your access to and use of https://horologybooks.com and any related media (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

We may update these Terms at any time by updating the “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance. You are responsible for reviewing the current Terms when you use the Site.

The Site is not intended for distribution or use in any jurisdiction where such use would be unlawful or subject us to registration. Access from other locations is at your own initiative and risk. The Site is not designed for HIPAA, FISMA, or GLBA-regulated use. Users must be 18+.

User Representations

By using the Site, you represent and warrant that: (a) information you provide is true and current; (b) you have legal capacity and agree to these Terms; (c) you are not a minor; (d) you will not access the Site via automated/non-human means; (e) you will not use the Site for unlawful purposes; and (f) your use complies with all laws. We may suspend/terminate access for violations.

User Registration

If the Site ever requires an account, you must keep your credentials confidential and are responsible for all activity under your account. We may reclaim usernames that are inappropriate or infringing.

Purchases & Payment

Accepted methods: Bank Wire Transfer, Zelle, Bitcoin. We do not accept credit cards on the Site.

All prices are in U.S. dollars and may be subject to applicable taxes. You agree to provide current and accurate order/contact information. We may correct pricing or order errors even after payment instructions are provided.

Crypto payments. Cryptocurrency payments are final and non-refundable. We are not responsible for network delays, failed transactions, price volatility, or losses from third-party wallets/exchanges. Amounts owed are satisfied only upon our confirmation of receipt of the required network confirmations and the agreed USD-equivalent at that time.

KYC/AML. We may request identity or address verification (KYC/AML) for fraud prevention or legal compliance. We may refuse, hold, or cancel orders we deem suspicious or non-compliant.

We may refuse, limit, or cancel orders (including per person, household, or address) at our discretion, including suspected reseller/bulk orders. We do not process subscriptions or recurring charges.

Products & Descriptions

We strive to present product details accurately; however, variations and errors may occur (e.g., colour on your display). Products are subject to availability and may be discontinued at any time. Prices may change without notice.

Shipping & Delivery

Orders typically process within 3–5 business days. Delivery times vary by destination and carrier; tracking may be provided when available. We are not responsible for delays caused by customs, carriers, or force majeure.

International Shipments & Customs

Returns/Refunds

All sales are final. No returns or refunds, except where required by law, or if we shipped the wrong item, or if an item arrives damaged. For such cases, contact us within 7 days of delivery with clear photos of the packaging and item; eligibility is determined at our discretion.

Limitation on Resale

Items purchased are for personal use and collection. Resale, redistribution, or commercial reproduction without our prior written consent is prohibited.

Third-Party Platforms, Links & Integrations

The Site may include links or connections to third-party platforms (e.g., carriers, payment rails, marketplaces, social networks, documentation, or external resources) and may display third-party content. These platforms are operated by others, not by us.

We do not control and are not responsible for any third-party platform’s security, availability, performance, responsiveness, usefulness, accuracy, or policies, and we make no warranties regarding them.
Your use of any third-party platform is at your sole risk and governed by that platform’s terms and privacy policy.
Any purchases made through third-party platforms are solely between you and the applicable third party.

Prohibited Activities

You agree not to: (a) collect Site data to build databases without permission; (b) attempt to obtain sensitive info (e.g., passwords); (c) bypass or interfere with security features; (d) harass, abuse, or harm others; (e) misuse support channels or submit false reports; (f) violate laws; (g) frame or link without authorization; (h) upload malware, spam, or excessive content; (i) use scraping, bots, or data-mining tools; (j) remove IP notices; (k) impersonate others; (l) deploy passive data collection mechanisms without consent; (m) interfere with networks; (n) threaten staff; (o) bypass access restrictions; (p) reverse-engineer the Site except as permitted by law; (q) use the Site to compete with us or for unauthorized commercial activity; (r) advertise or sell goods/services on the Site; or (s) sell or transfer your profile.

User-Generated Content & Feedback

The Site does not provide public posting areas for users. If you voluntarily send us content (e.g., emails, messages, photos, suggestions, “Submissions”):

You represent you own it or have rights to share it.
You retain ownership of your content; we do not claim title to it.
You grant us a non-exclusive, worldwide, royalty-free right to use feedback and suggestions for any lawful purpose without compensation.

Do not send illegal, infringing, defamatory, obscene, or otherwise objectionable material.

Modifications, Availability & Force Majeure

We may change, suspend, or discontinue any part of the Site without notice and have no obligation to update information. We are not liable for downtime, delays, errors, or inability to access the Site. We are not responsible for delays or failures caused by events beyond our reasonable control (including acts of God, labour disputes, outages, attacks, or carrier/customs disruptions).

We may monitor the Site, take legal action for violations, restrict or disable content, and manage the Site to protect our rights and ensure proper operation, all in our discretion.

Term & Termination

These Terms remain effective while you use the Site. We may suspend or terminate access (including blocking IPs) at any time, with or without notice, for any reason, including breach. If terminated, you may not register again under your name or another’s name. We may pursue all available remedies.

Governing Law & Venue

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Exclusive venue for any dispute shall be the state and federal courts located in the United States, and you consent to personal jurisdiction there.

Export Controls & Sanctions

You represent that you are not located in, organized under the laws of, or ordinarily resident in any sanctioned country and are not a denied/restricted party under applicable export or sanctions laws. You agree not to use the Site to transact with sanctioned parties or for prohibited end uses.

Corrections

Information on the Site may contain typographical errors or inaccuracies (including pricing/availability). We may correct or update information at any time without prior notice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, LICENSEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, REPLACEMENT COSTS). OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNT YOU PAID TO US IN THE 30 DAYS BEFORE THE CLAIM AROSE OR (B) USD $10.00. Indemnification

These Terms (and policies referenced on the Site, including our Privacy Policy) are the entire agreement between you and us regarding the Site and supersede prior understandings. Our failure to enforce a provision is not a waiver. If any provision is unenforceable, the remainder remains in effect. We may assign our rights/obligations at any time. No agency, partnership, joint venture, or employment is created by your use of the Site. These Terms shall not be construed against the drafter.
